1. Acceptance of Terms

By accessing and using Reptly ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

Reptly is an Instagram automation platform that allows you to automatically reply to comments and direct messages (DMs) based on rules you define.

2. Eligibility

To use Reptly, you must:

• Be at least 13 years old
• Have an Instagram Business Account or Creator Account
• Have a Facebook Page connected to your Instagram Business Account
• Comply with Instagram's Terms of Service and Community Guidelines
• Provide accurate and complete information during registration

3. Account Responsibilities

3.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately if unauthorized use occurs

3.2 Prohibited Uses

You MUST NOT use Reptly to:

• Send spam, illegal, or misleading content
• Violate others' intellectual property rights
• Engage in harassment, hate speech, or discrimination
• Distribute malware or harmful content
• Manipulate or abuse the automation system
• Violate Instagram or Meta policies
• Use the service for illegal purposes

4. Service Usage

4.1 Automation Rules

• You are fully responsible for all automation rules you create
• You must ensure your automated replies comply with Instagram policies
• Reptly reserves the right to disable automations that violate these terms

4.2 Rate Limits

Service usage is limited based on your chosen plan:

• Starter: 500 replies per month, 1 account
• Creator: 1,000 replies per month, 3 accounts
• Pro: 10,000 replies per month, 3 accounts, AI replies

4.3 Instagram API Limitations

Our service depends on Instagram Graph API. We are not responsible for:

• Changes or restrictions to the API by Meta/Instagram
• Downtime or issues with Instagram infrastructure
• Suspension or restriction of your Instagram account by Instagram

5. Payment and Subscription

5.1 Free Plan

The Starter plan is free forever with a limit of 500 replies per month.

5.2 Paid Plans

• Payments are processed monthly or annually
• Prices may change with 30 days' notice
• No refunds for payments already processed
• You can cancel your subscription at any time (effective next billing period)

5.3 Cancellation

If you cancel your subscription, you can continue using paid features until the end of your billing period. After that, your account will automatically downgrade to the free plan.

6. Intellectual Property

6.1 Reptly Ownership

All rights, title, and interest in Reptly (including code, design, logo, and content) belong to Reptly and are protected by intellectual property law.

6.2 Your Content

You retain all rights to content you create (automation rules, message templates, etc.). By using the service, you grant us a limited license to process your content to provide the service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES.

• We do not guarantee the service will be error-free or uninterrupted
• We do not guarantee specific results from using automation
• We are not responsible for Instagram's actions regarding your account
• We do not guarantee compatibility with all devices or browsers

8. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL REPTLY BE LIABLE FOR:

• Loss of data, profits, or business opportunities
• Indirect, incidental, or consequential damages
• Suspension or deletion of your Instagram account
• Actions by third parties (including Instagram/Meta)

Our total liability is limited to the amount you paid in the last 12 months.

9. Termination

9.1 By You

You can delete your account at any time through the dashboard or by contacting us. See Data Deletion Policy for details.

9.2 By Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You use the service for illegal purposes
• We are required by law
• You fail to pay subscription fees

10. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be notified via email or in-app notification at least 30 days in advance.

Continued use of the service after changes means you accept the new terms.

11. Governing Law

These terms are governed by the laws of the Republic of Indonesia. Any disputes will be resolved through the competent courts in Jakarta, Indonesia.
